The Farr Law Firm is pleased to announce that the Ethics Department of the Virginia State Bar has approved the Farr Law Firm’s claim that Evan Farr is the #1 Medicaid Asset Protection expert in the country.
Rule 7.1 of the Virginia Rules of Professional Conduct states that a lawyer shall not “use or participate in the use of any form of public communication if such communication contains a false, fraudulent, misleading, or deceptive statement or claim.” Evan Farr and the Farr Law Firm have always taken this rule (and all other rules of professional conduct) very seriously, as these rules form the foundation of legal ethics in the United States. The Virginia Rules of Professional Conduct are based on the American Bar Association Model Rules of Professional Conduct, which Model Rules have been adopted by 46 states and the District of Columbia (as of November 3, 2010).
By letter dated September 14, 2010, the Virginia State Bar, as part of its routine and proactive “lawyer advertising audit” process, requested verification that Evan Farr is “The #1 expert on Medicaid Asset Protection Trusts in the country” and “The #1 Medicaid Asset Protection expert in the country,” as claimed on the Farr Law Firm’s Website at http://www.farrlawfirm.com.
The Farr Law Firm provided a 61-page reply dated October 1, 2010, explaining and verifying the truth and verifiability of the statements that Evan Farr is “The #1 expert on Medicaid Asset Protection Trusts in the country” and “The #1 Medicaid Asset Protection expert in the country.”
By letter dated November 4, 2010, the Virginia State Bar responded that the Farr Law Firm had provided sufficient proof that Evan Farr is indeed the #1 expert on Medicaid Asset Protection Trusts in the country and the #1 Medicaid Asset Protection expert in the country, and Virginia State Bar closed its inquiry. The Virginia State Bar letter stated as follows:
“Thank you for your response dated October 1, 2010, to Ethics staffs inquiry with regard
to your claim that you are the number one expert on Medicaid Asset Protection in the country.
This letter is to inform you that your reply was satisfactory and we consider this matter closed.”
